“Normal contact” to be defined?

Published by Mark Tattersall in Children · 1/7/2019 16:25:08

There has been a change in the identity of the judge who heads up The Family Law. It is now Sir Andrew McFarlane, who was a children law specialist when he practised as a barrister. He is intending to meet all of the full-time Family Court judges and it would appear that one of the matters that he will be discussing with them is whether there should be “the issuing of general guidance on what a court would regard a reasonable amount or pattern of contact to be (in cases where there is no safeguarding risk to the child)”. My guess is that most judges will support such guidance being issued (and I think there are, in practice, judicial norms in any event, even though they have not been explicitly stated, such as the general expectation that most children will spend the whole of every second weekend with the “contact parent”).
